Have you got a fine for travelling without a ticket or with an invalid one? Here is what you can do.

Within 5 days from the date of the fine you can pay a reduced fine (LR 14/07/2014, No.7 art.139) using a postal order payable to: Cotral Spa, Via Bernardino Alimena, 105-00173 Rome, c /c 1001517604. The fine covers the cost of a ticket from the end of line to the arrival. This method of payment is also permitted for those violations concerning the provisions referred to in Presidential Decree 753/80, without the addition of the ticket, subject to the right of Cotral to claim compensation for any damage.

Remember to include the number of the fine in the motive.

Alternatively, within 30 days from the date of notification of the fine you can appeal (it is not possible to appeal the verification notice) by sending a written defence explaining your motivations:

  • by registered letter to Cotral Spa – Appeals Office , Via B. Alimena 00173 Rome;
  • by mail to ufficio.ricorsi@cotralspa.it;
  • by fax to 06 72052428;

In case of dismissal of the appeal, in addition to penalties, you will also be charged the cost of the ticket and the costs of the administrative procedure.

PENALTIES

If you are found travelling without ticket, for yourself as well as for people under your protection, for animals or luggage, you will be subject to payment of the full-price ticket corresponding to the entire journey, from the end of the line to the arrival and a fine ranging from 100,00 to 500,00 euro (as provided by the Lazio Regional Law No. 16 of 16.6.2003, art. 42 paragraph 2).

It will also be considered “user devoid of ticket”, and therefore punishable by fine, whoever:

  • is travelling with a non-validated ticket;
  • is travelling with an expired ticket;
  • is travelling on a special route without the appropriate ticket.
  • is using a ticket or pass whose fare is cheaper than the one expected for that route.
  • is travelling with a subsidised ticket (R.L. Lazio No. 30 of 16/7/1998) without the necessary documentation for it.
  • is travelling with a personal ticket not properly filled out or without the necessary documentation; the ticket is no longer in use;
  • is travelling with a subsidised Metrebus Card without receipt or with a non-readable receipt.

Anyone found with forged, altered tickets or tickets validated more than once, will be subject to fine from 103,00€ to 309,00€  in addition to the seizure of the same ticket (decriminalised articles by Legislative Decree 507/99), as established by Articles 465 and 466 of the criminal code, with the exception of criminal actions provided for by art. 462 C.C.

It is prohibited the sale of tickets and other personal travel documents, as well as non-personal tickets or travel documents after departure in accordance with Art. 24 of Presidential Decree 753/80. Anyone unduly using any personal travel document, whether transferor or transferee, will be subject to fine as above described, in accordance with Art. 5 of L.689/ 81 (“When more people cooperate in an administrative violation, each one of them will be subject to the related sanction”).

Anyone who violates the provisions concerning the behaviour of users of public transport operators listed in Presidential Decree 753/80 and endorsed in the list below is liable to a fine from 30,00 € to 250,00 € , as well as any amount of money for the repayment of damages caused to company’s assets.

Cotral is not responsible for damages caused by things, people or animals in case of infringement of the following rules:

  • it is forbidden to get on and off the transports when they have not come to a complete stop and using doors not indicated on the vehicle;
  • it is forbidden to operate alarms and emergency devices except in case of emergency or danger; – it is forbidden to throw anything out of the windows;

– no smoking;

  • it is forbidden to cause damage or dirty the vehicles and the company’s assets;
  • it is forbidden to engage in street vending activities, fundraising for whatever reason, sing, play and similar activities; – it is forbidden to get on the vehicle in a drunken state or under conditions that may offend the decency and may disturb other passengers;
  • it is forbidden to carry weapons, except for Public Security officers; – it is forbidden to carry dangerous or harmful substances.

Users harassing or disturbing other passengers and drivers can be removed from the vehicle at the discretion of the staff, without any kind of compensation. Offenders who provide false information or refuse to reveal them to the staff, or are found guilty of offenses against public officials according to the current Criminal Code, will be reported to the appropriate authorities.

The monthly and/or annual pass holders will have to present (within 5 days from the date of the report) the following documents at the Cotral offices:

  • Original Monthly Pass (validated before the sanction) + photocopy of the 10,00€ payment on C/C P 1001517604 – payable to Cotral Spa, specifying the reason “cost of proceedings” and the report number;
  • Original Annual Pass (validated before the sanction) + photocopy of the 10,00€ payment on C/C P 1001517604 – payable to Cotral Spa, specifying the reason “cost of proceedings” and the report number;

The offender will have to pay the fine using any postal form, to: Cotral Spa – Via Bernardino Alimena, 105-00173 Rome – n . c / c 1001517604 .

ADMINITRATIVE FINE

Those who have been subjected to administrative sanctions by Cotral staff, may present their defence directly to the Company within 30 days from the date of notification of the fine (it is not possible to appeal the verification notice), by registered letter to Cotral SpA – Appeals Office – Via B.Alimena , 105- 00173 Rome .
